Welcome to Peek-a-Play! By creating an account or using our App, you agree to these Terms and Conditions (“Terms”).

1. Use of the App

• The App is for task and routine management. It is not a substitute for professional, medical, psychological, or legal advice, and users agree that Peek-a-Play cannot be held responsible for any actions, decisions, or outcomes resulting from reliance on the App’s content.
• Users must be 18 or older to create an account.

2. User Consent and Responsibilities

By creating an account, you:

• Grant us the right to collect, use, share, and transfer your data under this Agreement, including but not limited to account information, usage data, and location data, to facilitate App functionality, improve services, and for potential business transactions. All data sharing or transfers will comply with applicable privacy laws and regulations to ensure the protection of your information.
• Agree to comply with applicable laws and avoid misuse of the App.

3. Data Ownership and Transfer

• We may share or transfer your data as part of business operations, mergers, or acquisitions. You will be notified in advance of such transfers, where possible, and may be provided with an option to opt out of the transfer of your data.
• Continued App use after updates signifies your acceptance of new terms.

4. Disclaimer of Warranties

The App is provided "as is" without guarantees of accuracy or reliability. Use at your own risk. The App's content is subject to change without notice, and Peek-a-Play cannot guarantee that features, information, or functionality will remain consistent over time.

5. Limitation of Liability

Peek-a-Play is not liable for:

• Indirect or incidental damages.
• Data loss due to user actions, third-party breaches, or unforeseen circumstances.
• Any claims arising from misuse of the App, reliance on its content, or unauthorized use of its features.

By using the App, you waive all claims against Peek-a-Play arising from permitted uses of the App and its content, including but not limited to decisions or actions taken based on the App’s features or information provided.

6. Indemnification

You agree to indemnify Peek-a-Play for claims arising from your App use or violation of these Terms.

7. Updates and Termination

We may update these Terms or terminate accounts for misuse. Continued use means acceptance of updates.

8. Governing Law and Disputes

These Terms are governed by Ukrainian law, with disputes resolved through binding arbitration conducted in English. The arbitration will take place at a mutually agreed-upon location, or virtually if necessary. Each party will bear its own arbitration costs and legal fees unless the arbitrator determines otherwise in accordance with applicable arbitration rules.
